Dell’s Cloud Trademark Stymied

On Tuesday the US Patent and Trademark Office suddenly yanked the so-called “notice of allowance” that gave Dell the mark but didn’t register it. The PTO has yet to explain why it returned Dell’s application for the examiners but suspicions are it was the hubbub created this week when the news broke that Dell had quietly put in its papers for the trademark a year ago March and that its application had crept through the normal Opposition Stage a few months ago completely unopposed and was thus at the point where it had six months to use it or lose it. It was presumably going to do that in connection its Dell Cloud Computing Solutions consultancy until the PTO cottoned on to the fact that it’s a generic catch phrase and, if so, barred from trademark. Dell also went out and bought a bunch of URLs like cloudcomputing.com.
