The court documents relating to the lawsuit allege that the relative of the plaintiff had been a patient at the defendant facility. On October 22, 2011, staff members with the defendant facility attempted to transfer the patient to a shower chair using a Hoyer lift. The documents further allege that the patient fell from the lift during this transfer and hit her head on the floor of the room. As a result of this fall, the patient allegedly suffered from a right frontal intraparenchymal hemorrhage and right frontal subarachnoid hemorrhage. The patient did not survive this traumatic brain injury.

The court documents state that the plaintiffs in the lawsuit are seeking compensatory damages that will help to pay for medical bills, economic damages, pain and suffering and other general damages for the patient and for severe emotional distress, grief, sorrow, loss of comfort, society, companionship and loss of probably support and for the patient's burial expenses.
